Skimboarding Terms of Service

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian. A parent or legal guardian who permits a minor to use the Service is responsible for the minor’s use of the Service.
The Service is not directed to children under 13. You may not use the Service if applicable law prohibits you from doing so.

Skimboarding helps users explore skimboarding locations, view community-informed location, condition, competition, and local event information, log skimboarding sessions, and access related features. Certain features are available without payment, while premium features require an active FirePass subscription.
The Service may display information derived from user-submitted sessions, third-party data providers, mapping services, and environmental data services. Information available through the Service may be incomplete, delayed, inaccurate, or unavailable.
Skimboarding helps users explore where people have skimmed. It does not promise that any location will be suitable at a particular time.

Some features require an account. You agree to provide accurate information, keep your sign-in credentials secure, and promptly notify us if you believe your account has been accessed without authorization.
You are responsible for activity performed through your account unless prohibited by applicable law. You may not impersonate another person, create an account using false information, transfer your account without permission, or use another person’s account without authorization.
You may request account deletion through the in-app account-deletion feature. Account deletion is subject to our Privacy Notice and applicable legal or record-retention requirements.

The Service allows users to submit skimboarding-session information, including locations, ratings, observed conditions, (“User Submissions”) and private notes .
You retain any ownership rights you have in your User Submissions. You grant Find the Fire a nonexclusive, worldwide, royalty-free license to host, store, process, organize, analyze, aggregate, and display your User Submissions as reasonably necessary to operate, maintain, secure, and improve the Service.
Your private notes will not be visible to other users.
This license ends when the relevant information is deleted, except to the extent retention is required by law or the information has been lawfully incorporated into non-identifiable, aggregated data.
In the current version of the Service:
- Other users may see submitted locations, ratings, observed conditions, and aggregated session information.
- Other users are not shown the identity of the person who submitted a session.
- Private session notes are not shown to other users.
You are responsible for the information you submit.
You agree not to submit information that is knowingly false, unlawful, infringing, threatening, malicious, or intended to disrupt or manipulate the Service.
Do not submit a location or other information if you do not have the right to provide it.

You may use the Service only for lawful, personal purposes and in accordance with these Terms. You may not:
- interfere with, damage, disable, overload, or disrupt the Service;
- attempt to gain unauthorized access to the Service, another account, or connected systems;
- introduce malware, malicious code, automated attacks, or harmful material;
- scrape, copy, harvest, or systematically extract Service data without our written permission;
- reverse engineer or attempt to obtain the Service’s source code except where applicable law expressly permits it;
- use the Service to violate another person’s privacy, intellectual-property rights, or other legal rights;
- submit fraudulent or deliberately misleading session information; or
- use the Service for illegal, abusive, deceptive, or harmful activity.

FirePass provides access to premium Skimboarding features. At launch, the United States storefront offers the following auto-renewing subscription options:
FirePass Monthly - US $6.99 per month
FirePass Seasonal - US $19.99 every three months
FirePass Yearly - US $59.99 per year
There is no free trial at launch. Prices in other countries or regions may differ because of local currency, taxes, and app-marketplace pricing. The price displayed by Apple App Store or Google Play when you confirm the purchase is the price that applies to that transaction.
Automatic renewal
FirePass subscriptions renew automatically for the selected subscription period until canceled. Your Apple App Store or Google Play account will be charged according to the terms shown during purchase.
You can manage or cancel the subscription through the subscription settings associated with the app marketplace where you purchased it (this means you need to cancel the service through Apple or Google directly. The app doesn’t manage the subscription service, that runs through the two companies)
You must cancel through Apple App Store or Google Play before the applicable renewal deadline to avoid the next charge. Find the Fire does not directly process app-store payments and cannot cancel an app-store subscription on your behalf.
Account or app deletion does not cancel FirePass
Deleting the Skimboarding app or deleting your Skimboarding account does NOT automatically cancel an active FirePass subscription. Cancel FirePass through Apple App Store or Google Play before deleting your account if you do not want it to renew. If you delete your Skimboarding account while FirePass remains active, you may lose access to paid features while the app marketplace continues billing the subscription.
Restoring purchases, billing, and refunds
The Service may provide a way to restore eligible purchases. Subscription billing, cancellation, renewal, and refund requests are governed by the policies of the app marketplace through which the subscription was purchased. Except where applicable law requires otherwise, refund requests for app-store purchases must be submitted to Apple or Google.
FirePass features may reasonably evolve as the Service develops. We will provide the subscription access marketed for the applicable paid subscription period and will not knowingly misrepresent the features included with FirePass.

Skimboarding is a physical activity that may involve serious risks, including changing water and weather conditions, waves, tides, currents, submerged objects, wildlife, collisions, falls, equipment failure, restricted access, and other hazards.
The Service provides recreational and informational guidance only. It does NOT provide professional weather forecasting, tide advice, marine-navigation services, emergency services, rescue services, medical advice, or safety advice. Never rely on the Service as your only source of information when deciding whether, where, or when to skimboard.
You are responsible for:
- checking current weather, tides, water, access, and local conditions using appropriate authoritative sources;
- evaluating your health, experience, skill level, equipment, and personal abilities;
- obeying laws, posted rules, closures, permits, and lifeguard or public-safety instructions;
- respecting private property and obtaining permission where required; and
- deciding whether an activity or location is safe and appropriate for you.
If conditions appear unsafe, do not enter the water. The Service is not an emergency-notification system. Contact local emergency services when assistance is needed.

The Service relies on or interacts with third-party services, which may include Apple, Google, RevenueCat, Supabase, mapping providers, and environmental-data providers. Their services and information are governed by their own terms and policies.
We do not control and cannot guarantee the accuracy, availability, security, or continued operation of third-party services or data. Maps, directions, weather information, tide information, wave information, rain information, and other environmental information may be estimated, delayed, incomplete, or incorrect.

The Service—including its software, design, graphics, text, branding, compilation of information, and other content provided by Find the Fire—is owned by or licensed to Find the Fire and is protected by applicable intellectual-property laws.
Subject to these Terms, Find the Fire grants you a limited, personal, nonexclusive, nontransferable, revocable license to use the Service for its intended purposes. This license does not permit you to sell, redistribute, sublicense, commercially exploit, or create unauthorized derivative works from the Service.
The names Skimboarding, FirePass, Find the Fire, and related logos and branding may not be used in a way that falsely suggests sponsorship, endorsement, or affiliation.

Our Privacy Notice (https://www.findthefire.ai/privacy-notice) explains how we collect, use, disclose, retain, and protect personal information. The Privacy Notice is incorporated into these Terms by reference. The Privacy Notice and these Terms will remain accessible through the Service’s Settings menu.

We work to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable because of maintenance, technical problems, provider outages, legal requirements, safety concerns, or circumstances outside our control.
We may add, modify, suspend, or discontinue features. When reasonably possible, we will provide notice of material changes that significantly affect active paid subscriptions. Nothing in this section limits rights that cannot lawfully be waived.

Find the Fire may restrict, suspend, or terminate an account when we reasonably believe that the user:
- violated these Terms or applicable law;
- engaged in fraud, deception, abuse, or harmful conduct;
- attempted to compromise the Service or another user’s account;
- infringed another person’s rights; or
- created a risk of harm or legal liability for users, Find the Fire, or third parties.
Where appropriate and legally required, we may provide notice and an opportunity to correct the violation. Serious, repeated, fraudulent, or dangerous conduct may result in immediate action.
Suspension, termination, or account deletion does not automatically cancel a FirePass subscription purchased through Apple App Store or Google Play. Marketplace cancellation and refund rules continue to apply.

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” Find the Fire disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service or its information will always be accurate, complete, current, secure, available, or suitable for a particular location or activity. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

To the fullest extent permitted by applicable law, Find the Fire and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, personal decisions made in reliance on the Service, or interruption of the Service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including any non-waivable rights available under applicable consumer-protection law.

To the extent permitted by applicable law, you are responsible for losses, claims, or expenses arising from your unlawful use of the Service, your material violation of these Terms, or your infringement of another person’s rights. This section does not apply to the extent a loss was caused by Find the Fire’s own unlawful conduct.

Your use of the Service may also be subject to the terms of the marketplace from which you downloaded it. For an application downloaded from Apple App Store, Apple’s Standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies to the license for the application unless a valid custom license applies. These Terms separately govern your use of the Skimboarding Service.
Apple and Google are not responsible for providing Skimboarding’s services, content, customer support, or FirePass benefits. If marketplace terms conflict with these Terms, the marketplace terms control only with respect to your relationship with that marketplace and to the extent required by applicable law.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to any mandatory rights you have under the laws where you live, disputes arising from these Terms or the Service will be handled by courts with jurisdiction in Alachua County, Florida.
If you are a consumer in the European Economic Area, United Kingdom, Switzerland, or another jurisdiction with mandatory consumer protections, nothing in these Terms deprives you of rights that cannot be waived by contract or prevents you from bringing a claim where applicable consumer law permits.
These Terms do not require arbitration and do not contain a class-action waiver.

We may update these Terms as the Service or legal requirements change. When changes are material, we will provide reasonable notice through the Service, by email, or through another appropriate method. We may ask you to accept revised Terms before continuing to use the Service.
The updated Terms will identify their effective date. Continuing to use the Service after revised Terms take effect constitutes acceptance where permitted by applicable law. If you do not agree to revised Terms, you should stop using the Service and cancel any active FirePass subscription through the applicable app marketplace.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign your rights under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or other lawful business transfer.
These Terms, the Privacy Notice, and applicable app-marketplace terms constitute the agreement governing your use of the Service. Section headings are for convenience only.

These Terms of Service (the “Terms”) are an agreement between you and Find the Fire LLC (“Find the Fire,” “we,” “us,” or “our”) governing your access to and use of the Skimboarding mobile application, related websites, and services (collectively, the “Service”).
Please read these Terms carefully. By creating an account, tapping “I Agree,” purchasing FirePass, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Notice (https://www.findthefire.ai/privacy-notice). If you do not agree, do not use the Service.
